These Terms of Service ("Terms") govern your access to and use of the website https://cammakes3d.com (the "Site"), the products we sell, and our downloadable desktop software applications (each, an "App," and together with the Site, the "Services"), operated by CamMakes3D ("CamMakes3D," "we," "us," or "our").
By using the Services, placing an order, or activating a license, you agree to these Terms. If you do not agree, do not use the Services. These Terms incorporate our Privacy Policy, our Shipping & Returns policy, and β where applicable β our Tools & Credits Terms.
1. Eligibility
You must be at least 16 years old (or the age of majority where you live) and able to form a binding contract to use the Services. By using the Services you represent that you meet these requirements and that the information you provide is accurate.
2. Orders, pricing, and availability
- Product photos and on-screen renders are representative; final color, texture, and finish may vary slightly, especially on 3D-printed and laser-cut items.
- Many items are made to order or custom (colors, registration numbers, made-to-fit parts). Prices, specifications, and availability may change at any time before you place an order.
- Your order is an offer to buy. We may accept or decline it, and we may cancel an order (with a refund of amounts paid for that order) if a product is unavailable, mispriced, or the order appears fraudulent.
- Because custom and made-to-order items go into production quickly, changes or cancellations may not be possible once production has begun. Contact us as soon as possible if you need to change an order.
3. Payment and taxes
- Payments are processed securely by Stripe and PayPal/Venmo. By paying, you authorize the applicable processor to charge your selected payment method. We do not receive or store your full payment card number.
- You are responsible for any applicable sales or use tax, which is calculated and shown at checkout where required (for example, Tennessee sales tax).
- If a payment is reversed, charged back, or fails after fulfillment, we may suspend related licenses or accounts and pursue amounts owed.
4. Shipping, returns, and physical products
Shipping timeframes, risk of loss, returns, and damage claims for physical goods are described in our Shipping & Returns policy, which is part of these Terms. In short: most items are made to order; custom items generally cannot be returned; and if an item arrives damaged or incorrect, contact us promptly and we will make it right.
5. Software licenses
5.1 License grant
When you purchase a license for an App, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use that App for your own personal or internal business use, subject to these Terms and to the number of machines (activations) and the feature tier your license includes.
5.2 What a license is (and isn't)
The Apps are licensed, not sold. We and our licensors retain all ownership of the Apps and all related intellectual property. A license key is our property and remains subject to these Terms even after delivery.
5.3 Tiers, trials, and updates
- Licenses may be offered in tiers (for example, Basic and Full), which unlock different features. A free trial, where offered, provides full features for a limited time and is limited to one trial per person and per machine, per App.
- Your license works for the life of the product unless revoked under these Terms. Free updates are provided for the window included with your purchase (or, for a trial, none). After the update window ends, you may continue to use the versions you were entitled to during that window, but new versions may require a paid update or upgrade.
- We may release updates, and may change, add, or discontinue features. We are not obligated to maintain, update, or support any App indefinitely.
5.4 Restrictions
You agree not to, and not to help anyone else:
- copy, resell, rent, lease, sublicense, distribute, or share the App or your license key beyond the terms you purchased;
- share, publish, or use a key on more machines than your license allows, or circumvent, disable, or tamper with licensing, activation, feature-tier, or trial limits;
- reverse engineer, decompile, or disassemble the App, except to the extent this restriction is prohibited by applicable law; or
- use the Services to build a competing product, or in any unlawful manner.
5.5 Activation, verification, and revocation
To operate licensing and prevent abuse, the Apps send a non-reversible machine identifier, the license key, the App version, and basic system information to our license server (see the Privacy Policy). We may verify licenses periodically. We may suspend or revoke a license or trial, without refund, where we reasonably believe there has been key sharing, activation-limit circumvention, chargeback or payment fraud, or any breach of these Terms.
5.6 Refunds for digital products
Except where a refund is required by applicable law, license keys and other digital products are non-refundable once delivered or activated. If you believe a key was charged in error or never delivered, contact us and we will investigate.
6. Online tools and credits
Certain tools on the Site are provided as online services and may use credits or passes. Your use of those tools, and the purchase and use of credits and passes, are governed by our Tools & Credits Terms, which are part of these Terms.
7. Your content and submissions
- Files you process: You are responsible for having the rights to any artwork, designs, or files you use with the Apps or upload to the online tools, and for ensuring your use does not infringe anyone's rights. You keep ownership of your files. For online tools, you grant us a limited license to process your uploaded files solely to generate your results (see the Privacy Policy for how uploads are handled and deleted).
- Feedback, bug reports, and feature requests: If you send us feedback, bug reports, or feature requests, you grant us a perpetual, worldwide, royalty-free license to use them to operate and improve the Services, with no obligation to implement anything or to compensate you.
8. Acceptable use
You agree not to misuse the Services, including by: violating any law; infringing others' rights; uploading malicious code; attempting to gain unauthorized access to the Services or other users' data; interfering with or overloading the Services; scraping or automated bulk access except as expressly permitted; or using the Services to produce unlawful or infringing items.
9. Intellectual property
The Site and its content β including text, graphics, logos, the CamMakes3D name and marks, and software β are owned by CamMakes3D or our licensors and are protected by law. Except for the limited rights expressly granted in these Terms, you receive no rights to our intellectual property, and you may not use our name, logos, or marks without our written permission.
10. Disclaimers
The Services, products, Apps, and any exported or generated files are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
You are completely responsible for inspecting and checking every file, digital design, and physical part before you print, cut, or run it on your own equipment, or use it on the water or in any real-world physical application. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any App will be compatible with your hardware or setup. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
11. Limitation of liability
To the maximum extent permitted by applicable law, CamMakes3D (including its owner, employees, or service providers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of profits, loss of data, property damage, equipment failure, laser cutter or 3D printer damage, or bodily injury arising out of or relating to your use of or inability to use the Services or any physical or digital products purchased through the Site.
In no event shall CamMakes3D's total cumulative liability for all claims arising out of or related to these Terms exceed the total amount actually paid by you to CamMakes3D for the specific product or service license giving rise to the dispute in the twelve (12) months preceding the event.
12. Indemnification
You agree to defend, indemnify, and hold harmless CamMakes3D from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your violation of these Terms, your misuse of the Services, or any intellectual property infringement related to files or artwork you upload or process through our tools.
13. Governing law and venue
These Terms and any dispute arising out of your use of the Services shall be governed exclusively by the laws of the State of Tennessee, USA, without regard to its conflict of law principles. You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Knox County, Tennessee, and you consent to the personal jurisdiction of those courts.
14. Dispute resolution (Arbitration & Class Action Waiver)
Any dispute or claim relating in any way to your use of the Services or products sold by CamMakes3D will be resolved by binding, individual arbitration, rather than in court. You and CamMakes3D agree that each party may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
15. Severability and entire agreement
If any provision of these Terms is found to be invalid or unenforceable by a court of law, that provision will be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions of these Terms will remain in full force and effect. These Terms, alongside the Privacy Policy and referenced sub-policies, constitute the entire agreement between you and CamMakes3D.
16. Changes to these Terms
We reserve the right to modify these Terms at any time. We will post modified versions on this page and update the "Last updated" date. Material changes will be communicated via email or a noticeable text alert across the Site. Your continued use of the Services after updates go live constitutes acceptance of the new Terms.
